Digital Innocence Initiative

The Digital Innocence Initiative is a first-of-its-kind, not-for-profit organization dedicated to preventing and overturning wrongful convictions using digital evidence. We provide technical knowledge, guidance, and resources on digital evidence to public defenders and individuals pursuing post-conviction claims of actual innocence.

The Need for Post-Conviction Review

Through our work with public defenders, we learned about the serious problem of wrongful convictions caused by digital evidence.  While we did not set out to drive criminal justice reform, we recognized the need for change and the impact we could make by sharing our knowledge and resources with public defenders both nationwide and globally.

 

The Evolution of Digital Evidence in Criminal Cases

The use of digital evidence in criminal cases has evolved over time as technology has advanced and now constitutes 90% of current cases.This information aims to provide an overview of the use of digital evidence in criminal cases, highlight the number of wrongful convictions associated with digital evidence, and explore areas where new technology can be used to uncover additional evidence.

Criteria for Post-Conviction Review

We are the first to recognize the urgent need for nationwide post-conviction review in cases involving digital evidence.  To address this, we created the first-ever Post Conviction Review Criteria—a framework designed to help defenders identify key evidence, locate it, apply new forensic technologies, and determine the best methods for uncovering new digital evidence.

Digital Evidence Toolbox

The Digital Evidence Toolbox is designed to prevent and overturn wrongful convictions by providing expert digital forensics knowledge, case investigation tools, and legal defense resources. It empowers public defenders, criminal defense attorneys, and investigators with the resources needed to strengthen public defense and ensure fair and equitable representation in today’s criminal justice system.

Digital Evidence Review Unit (DERU) Signup

Our Mission is to expand the use of digital evidence in preventing wrongful convictions by building a nationwide coalition of defense-oriented organizations. Central to this effort is the establishment of Digital Evidence Review Units (DERUs), ensuring that public defenders have the training, resources, and solutions needed to leverage digital evidence effectively. We aim to set a national minimum standard for digital evidence training, strengthening public defense and promoting a fairer, more equitable criminal justice system.

At eLab Forensics, we help public defenders and criminal defense attorneys uncover and analyze digital evidence. Our team specializes in social media forensics, mobile data extraction, computer forensics, cell site analysis, and digital evidence consulting to strengthen defense strategies and ensure fair representation in the courtroom.
